TERMS AND CONDITIONS OF SALE USING REMOTE COMMUNICATION MEANS AND ELECTRONIC SERVICES

These Terms and Conditions define the rules for making purchases in the online store operated by the Seller at http://sklepogrodniczyolza.pl.

§ 1 Definitions

1. Terms and Conditions – these Terms and Conditions. Regarding services provided electronically, the Terms and Conditions constitute the regulations referred to in Art. 8 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2002, No. 144, item 1204, as amended).

2. Client (Buyer) – a natural person who is at least 13 years old; if under 18, the consent of their legal representative is required, as well as a legal person or organizational unit without legal personality, authorized under special regulations, who makes or intends to make an Order or uses other services of the Online Store (including Consumers).

3. Subject of the transaction – Goods listed and described on the Online Store website. The Seller makes every effort to ensure that the offer presented on the pages is up to date. If some ordered goods are unavailable, the Seller will promptly inform the Buyer by phone or email.

4. Goods – a movable item covered by the Sales Agreement.

5. Additional service – a service provided by the Service Provider to the Client outside the Online Store in connection with the nature of the products sold.

6. Product – Goods and Additional Services presented in the Online Store.

7. Sales Agreement – a contract for the sale of Products under the Civil Code, concluded between the Service Provider and the Client using remote communication means (including by phone).

8. I&L Online Store (Store, Online Store) – an online service available at http://sklepogrodniczyolza.pl, through which the Client can purchase Products.

9. Party – Service Provider and Client.

10. Store Page – any page or subpage under http://sklepogrodniczyolza.pl.

11. Order – a declaration of the Client’s will specifying the type and quantity of Products, aimed directly at concluding a Distance Sales Agreement through the Online Store.

§ 2 General rules

1. Placing an Order in the Online Store requires that the Buyer read and accept these Terms and Conditions during the Order process.

2. The I&L Online Store sells retail via the Internet.

3. All products offered in the I&L store are brand new, originally packaged, free of physical and legal defects, and legally introduced to the Polish market.

§ 3 Placing orders

1. All prices on the website http://sklepogrodniczyolza.pl are gross prices in Polish zloty (including VAT). Prices do not include shipping costs.

2. Orders are accepted via the website.

3. Orders can be placed online 24/7 throughout the year.

4. An Order is valid if the Buyer correctly fills in the order form and provides accurate contact details, including the address for delivery, phone number, and email address.

5. If the data is incomplete, the Seller will contact the Buyer. If contact is impossible, the Seller may cancel the Order.

6. During the Order process, the Buyer may consent to the storage of personal data in the Seller’s database for processing related to the Order. In such a case, the Buyer has the right to access, correct, or request deletion of their data.

7. The Buyer may use the system’s option to remember their data to facilitate placing future Orders. The login is the Buyer’s email. The password is known only to the Client, who must keep it confidential.

8. After successfully placing an Order, the Client will receive an automatic confirmation from the store.

9. Order processing begins upon receipt of payment for bank transfer orders or at the moment of ordering for card payments or “cash on delivery” options.

§ 4 Shipping costs and delivery time

1. Goods are shipped to the address provided in the order form or communicated by phone or email. The Store will promptly notify the Client of any errors in the order form that may prevent or delay delivery.

2. Goods are delivered via specialized courier companies. In some cases, personal pickup at the Seller’s premises is possible.

3. Delivery times are estimated and listed with each product. For bank transfer payments, add the time for payment clearance (usually 1–2 business days).

4. The Buyer is responsible for shipping costs as specified in the shipping price list. Shipping costs are displayed during checkout or on the product page if free shipping applies.

§ 5 Payment

1. A receipt or invoice will be issued for every sold item.

2. Payment may be made via cash on delivery, electronic payment system PayU, Credit Agricole Bank Polska S.A. installment plan, or bank transfer.

3. For some products, the Service Provider reserves the right to limit payment methods by disabling certain options on the website.

§ 6 Receiving goods

1. Deliveries are made within Poland.

2. Upon receiving a parcel, check for damage to the packaging, seals, or tapes. If damaged, do not accept the package, and document the issue with the courier. Contact the Seller immediately. Failure to note issues at delivery may affect the outcome of claims regarding damaged or stolen shipments.

§ 7 Withdrawal from the contract

1. Consumers have the right to withdraw from distance contracts within 14 days without giving a reason (based on Art. 7, Act of 2 March 2000 on consumer rights, Journal of Laws No. 22, item 271, as amended).

2. This applies only to consumer sales (natural persons purchasing for non-business purposes).

3. Returned goods must be complete, undamaged, and show no signs of use beyond what is necessary to check the product.

4. Return shipping costs are borne by the Buyer. Items must be sent back within 14 days after receiving return instructions.

5. A written withdrawal statement and bank account number must accompany the return shipment.

§ 8 Complaints procedure

1. Products have manufacturer, importer, or seller warranties valid in Poland. Warranty duration is listed in the product description. Detailed warranty conditions are provided by the guarantor.

2. If the Service Provider provides the warranty, the product must be sent at the Service Provider’s expense.

3. Repaired products are returned to the Client at the Service Provider’s expense.

4. For non-conformity complaints, the product must be returned with a written description of the issue and expectations.

5. The Client loses rights under the consumer sales act if they fail to notify the store of non-conformity within two months of discovery.

§ 9 Privacy policy and personal data protection

1. The Service Provider is the administrator of personal data provided by store clients during purchases.

2. Personal data is used to fulfill sales contracts and may be shared with delivery services or, for installment purchases, financing institutions. Clients may access and correct their data. Providing data is voluntary.

§ 10 Final provisions

1. Matters not covered in these Terms and Conditions are governed by: the Act of 2 March 2000 on consumer rights, the Act of 27 July 2002 on special consumer sales conditions, and the Civil Code of 23 April 1964.

2. Disputes arising from these Terms and Conditions or related contracts will be resolved by the competent court according to the Civil Procedure Code of 17 November 1964.

3. The Service Provider reserves the right to modify these Terms and Conditions; contracts concluded before changes are governed by the version in effect at the time of the order.
